To get the measure past this first barrier and enable formal floor discussion and opening of the bill to changes, 60 votes—that is, at least seven Democrats must join the 53-member Republican majority—are needed.
The Treasury's strong drive emphasizes a growing need to create a clear legislative framework by defining clear jurisdictional borders between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). Presented by Bessent as a vital national security action, the CLARITY Act seeks to remove market-crippling enforcement uncertainty and provide federal agencies with more tools to fight illegal crypto activity. But the bill is under fierce headwinds from important sector lobbying, skeptical Democratic legislators, and certain conservative dissenters worried about financial system protections and possible banking sector spillovers.
The next September 15 poll is a major litmus test for the direction of digital asset regulation in the United States. Reaching the 60-vote threshold will let the Senate move to floor discussions and help to shape any changes before any final enactment attempt. Conversely, failing to obtain cloture will essentially stop the present version of the bill from moving forward and leave crypto market regulation in regulatory uncertainty unless Senate leaders can bring the bill back through different legislative packages.
