Congressional Clock vs. Crypto Clarity: CLARITY Act Passage Odds Sink to 30% Despite Law Enforcement Support

There is an increasing gulf between grassroots support and legal possibility for the Digital Asset Market Clarity Act (CLARITY Act). Strong endorsements of the measure have come from law enforcement groups, especially the National Organization of Black Law Enforcement Executives (NOBLE). Supporters point out that having uniform anti-money laundering (AML) and Know Your Customer (KYC) procedures for digital asset brokers gives much-needed legal clarity that enables federal officials to fight crypto-related crime while also giving legitimate industry players clear compliance rules.

Even though law enforcement supports the bill, its legislative schedule is fast slipping. Galaxy Research and leading prediction markets have lowered the likelihood that the CLARITY Act will pass in 2026 to 30%, from 50–60% earlier this year. Getting special floor time for a complete vote becomes less and less probable given the approaching August Senate recess and a packed legislative calendar. Moreover, clearing the 60-vote Senate filibuster threshold remains a significant obstacle as unresolved conflicts around non-custodial developer exceptions and regulatory control continue to delay floor movement despite prior approval by the House and the Senate Banking Committee.

Intriguingly, the digital asset sector has absorbed the legislative slowdown with noticeable resilience. As market experts at companies like Charles Schwab observe that institutional investors have already priced in the prospect of prolonged legislative delays, major cryptocurrencies including Bitcoin have held strong. Analysts highlight an asymmetric upside: any unexpected bipartisan compromise before the midterm elections may serve as a strong impetus for institutional digital asset demand to be repriced in the positive direction given a stalled legislative timetable that has become the baseline expectation.
