Democrat Brian Poindexter is set to replace Republican Rep. Max Miller in Ohio’s 7th Congressional District after an Associated Press call Wednesday, giving Democrats a House seat held by the GOP.

Miller was seeking a third term. Poindexter is a union ironworker who previously served on Brook Park’s City Council. The northeastern Ohio district had generally favored Republicans.

The Cook Political Report moved the race from Likely Republican to Toss Up in August, citing allegations against Miller and his decision to remain on the ballot.

Miller’s former wife, Emily Moreno, accused him of abusing her and their young daughter. Miller denied the allegations. Ideastream Public Media reported that a county children-services investigation did not substantiate the allegation that Miller abused his daughter.

The House Committee on Ethics said Aug. 4 that it was reviewing allegations that Miller may have engaged in domestic violence and abuse or illegal drug use. The committee cautioned that opening a review did not establish a violation.

Ohio’s results remain unofficial. County election boards must complete their canvasses and certify results within 21 days of Election Day, the secretary of state said. The state will then review the county reports before final certification.
