Former FBI Director James Comey denied allegations in a new federal case after prosecutors accused him of disclosing national defense information, opening a dispute over a 10-year deadline to bring charges.
The U.S. Department of Justice (DOJ) filed a three-page criminal information in Washington on Oct. 5. A court unsealed the filing Monday, Oct. 26. It accuses Comey of sharing national defense information with a reporter and conspiring to disclose it. EconoTimes previously outlined the filing’s allegations.
In a video posted on Instagram, Comey said, “I’m still innocent,” and said he believed in an independent federal judiciary.
The DOJ filed the information seeking to toll a 10-year deadline for bringing charges. Comey’s lawyers argue the filing cannot satisfy that deadline, according to EconoTimes’ earlier report on the dispute. Mediaite reported that Comey’s lawyer Patrick Fitzgerald said the filing was not approved by a judge or issued by a grand jury.
Al Jazeera described the new case as part of a two-year sequence of prosecution attempts involving Comey. A 2025 indictment accusing him of making false statements to Congress and obstructing a congressional proceeding was dismissed without prejudice on Nov. 24, 2025, after a judge found the prosecutor had been improperly appointed. In a separate case, a North Carolina grand jury indicted Comey on April 28, 2026, over an Instagram post showing seashells arranged as “86 47.”
