Kremlin Speed, Kremlin Control: Russia Outpaces the U.S. in Crypto Regulation

Following President Vladimir Putin's signing of extensive digital-asset law on August 4, Russia has formally surpassed the United States in putting a national cryptocurrency regulatory framework into place. The law creates centralized state control while the U.S. is mired in congressional discussions over the CLARITY Act, set to go into effect on September 1, 2026. Strict operational controls come at the expense of Russia's legislative head start, however; they make for a highly constrained setting for daily market players as compared to Western norms.

Under the new regulations, all crypto service companies—exchanges, brokers, and custodians—must register with a special Bank of Russia registry, join a financial-market self-regulatory group, and keep at least 15 million rubles ($187,000) in capital. The structure sharply divides investor classes: non-qualified retail investors are subject to suitability testing and a tight yearly purchasing limit of 300,000 rubles per intermediary, only on highly liquid digital assets. Qualified investors who pass testing can transact any volume and access a wider range of assets.

Significantly, the law forbids using Bitcoin and other cryptocurrencies for internal payments, therefore protecting the ruble as the only legal tender inside Russia. Conversely, it specifically allows Russian companies to use digital assets for cross-border trade settlements, therefore providing a crucial legal channel for sanctions-sensitive cross-border finance. Though domestic infrastructure, depositories, and issuance will be under phased supervision through 2027, the statute represents a significant change toward state-controlled crypto integration that contrasts sharply with the jurisdictional conflicts between the SEC and CFTC in the United States.
