Newark Mayor Ras Baraka has filed a federal lawsuit against two law enforcement officials, claiming his arrest at a New Jersey immigration detention center was politically motivated by the Trump administration. Baraka, a Democrat and current candidate for New Jersey governor, was arrested on May 9 at Delaney Hall in Newark during a tense standoff while accompanying U.S. Rep. LaMonica McIver and other Democratic lawmakers on an oversight visit.
The lawsuit names Acting U.S. Attorney Alina Habba, a former Trump attorney, and Homeland Security official Ricky Patel, alleging they ordered the arrest without cause and pursued malicious prosecution. Baraka claims a guard allowed him onto the property and that he agreed to leave after being threatened with arrest, making the charges baseless.
Baraka was charged with trespassing, but the case was dropped 10 days later. Habba defended the dismissal as a move to “move forward,” yet her office soon filed new charges against McIver, accusing her of resisting officers during the arrest. McIver, who has not entered a plea, called the charges politically driven.
Baraka’s lawsuit, filed in the U.S. District Court of New Jersey, alleges constitutional violations, defamation, and abuse of power. It seeks damages for emotional and reputational harm. Legal experts note the case may face hurdles due to immunity typically granted to federal officials acting in their official capacity. However, Baraka argues that Habba and Patel exceeded their lawful authority.
The incident has drawn national attention amid heightened tensions between Democrats and Trump-era immigration policies. A DHS spokeswoman stated Baraka’s actions endangered law enforcement and staff at the facility. Baraka insists the arrest was an attempt to intimidate Democratic officials challenging federal immigration practices.
