InterDigital said Tuesday that a Brazilian court issued a preliminary injunction barring TCL from implementing HEVC in devices it makes, imports or offers for sale in Brazil, in a dispute over two patents. InterDigital said the ruling came from the 3rd Business Court for the Judicial District of the Capital, in Rio de Janeiro.
InterDigital said the court adopted findings from an independent expert report commissioned for the case. The company said those findings supported its position that TCL infringed two patents essential to HEVC and that its licensing offers met the fair, reasonable and nondiscriminatory (FRAND) standard.
InterDigital said the court noted TCL's offers were lower by “a different order of magnitude.” Josh Schmidt, InterDigital's chief legal officer, urged TCL to license the company's portfolio on terms that fairly reflect its value. Schmidt said HEVC is important to video encoding and decoding on devices such as TCL's. InterDigital develops and licenses wireless and video technologies, according to the company.
