HM Land Registry issued guidance Monday on reporting certain contractual control rights over registered land in England and Wales, preparing for rules intended to make influence over property use more visible.
The rules take effect April 6, 2027. From then, digital reports will be required for covered agreements involving registered land. The agreements include option agreements, conditional contracts and pre-emption rights.
Such agreements can affect how land is used or developed even when its owner does not change. HM Land Registry says disclosure will make that contractual influence easier to see in the property market.
Practice Guide 84 describes which land and agreements fall within the rules and when a report is required. It also explains who must submit the information, what supporting material is needed and how to file it.
The registry advises conveyancers to identify affected transactions early and keep relevant contracts. It says preparing ahead of the new requirements could prevent delays or added costs.
That preparation may involve obtaining an individual grantor’s date and place of birth. Conveyancers may also need spatial data showing the affected area if a right covers less than the full registered title.
HM Land Registry’s digital submission service is scheduled to open when the regulations take effect on April 6, 2027. The registry expects the data it collects to become publicly available from April 2028.
