New York Governor Kathy Hochul declared a statewide disaster emergency on Monday in response to a growing measles outbreak, marking the first such declaration by a U.S. state since measles cases began rising sharply in 2025.

The emergency order expands access to measles-mumps-rubella (MMR) vaccines and gives additional healthcare professionals authority to respond to suspected infections. The move comes as cases increase in under-immunized rural communities across New York and neighboring Pennsylvania.

New York has recorded 108 measles cases this year through October 3, according to the executive order. Of those, 92 have been reported since July 15 across rural communities in 18 counties where vaccination rates are relatively low. The total is significantly above the state’s typical annual measles caseload.

The situation is even more severe in Pennsylvania, which shares a border with New York. Pennsylvania had reported 977 measles cases and five deaths as of October 2, with much of the outbreak concentrated in rural counties bordering New York, the order said.

Under Hochul’s emergency declaration, registered nurses are permitted to order laboratory tests for people suspected of having measles. Pharmacists are also authorized to administer MMR vaccines to children as young as two years old, expanding the number of locations where families can obtain vaccinations.

The order additionally requires healthcare providers to report all MMR vaccinations to New York state or New York City immunization registries within 72 hours. It temporarily waives requirements for adults to consent to having their vaccination records reported to those registries.

However, consent requirements for receiving an MMR vaccine remain unchanged. Patients or their legal guardians must still approve the vaccination itself.

New York’s measles disaster emergency took effect Monday and is scheduled to remain in place through November 4 as health officials work to contain the outbreak and increase vaccination coverage.
