Hoiby’s appeal hearing is due in February, while a separate review will determine whether he may leave custody, Reuters reported.
Hoiby, 29, appealed a June conviction that resulted in a four-year sentence for two rape counts, domestic violence and other offenses, Reuters reported.
Hoiby remains under electronic monitoring at the royal estate outside Oslo, Reuters reported. If the release order takes effect, he would be allowed to remove the monitor.
The order requires police check-ins and drug and alcohol screening over the next month; prosecutors had sought continued detention, Reuters reported.
Hoiby is Queen Mette-Marit’s son from an earlier relationship and the stepson of King Haakon. His appeal hearing is scheduled to begin in February.
