According to the lawsuit, throughout the Class Period defendants made false and/or misleading statements and/or failed to disclose that: (1) Adeptus Health was engaging in predatory billing practices, which exposed Adeptus Health to numerous risks and possible penalties, including civil and/or criminal sanctions, and exclusion from federal and/or state healthcare programs; (2) Adeptus Health’s financial statements had not been prepared in conformity with generally accepted accounting principles; and (3) contrary to representations about Adeptus Health’s practice of referring lower acuity patients to urgent care facilities, it routinely treated and excessively billed these patients. When the true details entered the market, the lawsuit claims that investors suffered damages.
