Indian Loan Guarantors Can Face Repayment Claims After Borrower Defaults

TransUnion CIBIL says a borrower’s default affects the guarantor’s credit score, while the guarantee’s terms shape the extent of the liability.

An individual who guarantees another person’s loan in India can become responsible for repayment if the borrower defaults. The default may also affect the guarantor’s credit record. The extent of the obligation depends on the guarantee’s terms and any later legal enforcement.

The Indian Contract Act defines a guarantee in Section 126. Section 128 generally makes the guarantor’s responsibility match the borrower’s, unless the contract provides otherwise. TransUnion CIBIL describes a guarantor as providing security for the loan amount, placing repayment risk on that person if the borrower fails to pay.

In a July 2024 ruling in BRS Ventures Investments Ltd. v. SREI Infrastructure Finance Ltd., the Supreme Court of India said a creditor need not exhaust recovery options against the borrower before pursuing the guarantor. The dispute involved a corporate guarantee, and the terms of an individual guarantee still matter.

If a court issues a money decree, enforcement may include attaching and selling some property belonging to the judgment debtor. Section 60 of the Code of Civil Procedure lists property exempt from attachment. That provision addresses recovery after a decree; it does not establish that signing a guarantee automatically freezes a bank account.

The Reserve Bank of India (RBI) 2025 credit-information directions provide for guarantors to be included in credit reports where applicable and call for credit institutions to use those reports in credit appraisals. TransUnion CIBIL says a default by the principal borrower will affect the guarantor’s credit score.

For housing finance company loans, separate RBI directions also address whether the lender can use other money the guarantor holds with it. Before a person agrees to guarantee such a loan, the company must explain the potential size and circumstances of the obligation, and disclose whether it is capped and when it ends.
