The GENIUS Act: Architecting the Future of Federal Stablecoin Regulation

By offering new regulations in December 2025, the Federal Deposit Insurance Corporation (FDIC) clearly moved toward incorporating digital assets into the mainstream banking system. The landmark piece of legislation passed in July 2025 and signed by President Trump, the GENIUS Act, relies on these rules as its operational foundation. The proposal particularly describes the application and oversight procedures for FDIC-insured banks that want to distribute "payment stablecoins" via specialized subsidiaries, therefore guaranteeing that these digital instruments are handled with the same care as conventional financial goods.

Under the suggested provisions, the FDIC must conduct a thorough review of banks using five legislative criteria. Among these are the calibre of reserve backing, management's level of competence, and the clarity of redemption rules. Any rejection of an application must be supported by a thorough written justification to guarantee justice and due process; banks are given a 30-day period to appeal such judgments. This framework seeks to encourage innovation in USD-backed stablecoins by requiring 100% reserves, frequent independent audits, and rigorous compliance to Anti-Money Laundering (AML) standards.

The dual-path regulatory environment generated by the GENIUS Act sets it apart from earlier legislative efforts including the STABLE Act. Larger national issuers come under direct federal jurisdiction, whereas those with an issuance volume of less than 10 billion USD can be handled under state-certified systems coordinated by a joint committee of the Federal Reserve, Treasury, and FDIC. Notably, the Act forbids yield-bearing stablecoins for customers to stop them from being utilized as unregulated high-interest savings vehicles. The regulations are still in the official notice-and-comment stage as of early 2026, indicating a slow but consistent movement toward a federally controlled digital currency environment.
