SUMMARY NOTICE OF PENDENCY OF CLASS ACTION AND PROPOSED SETTLEMENT
TO: ALL PERSONS AND ENTITIES THAT PURCHASED OR ACQUIRED COMMON STOCK OF ADVANCED EMISSIONS SOLUTIONS, INC. (“ADES” OR THE “COMPANY”) (TICKER SYMBOL: ADES) BETWEEN MAY 12, 2011, AND JANUARY 29, 2015, BOTH DATES INCLUSIVE (THE “CLASS PERIOD”).

YOU ARE HEREBY NOTIFIED that a proposed Settlement has been reached in this Action.[1] A hearing will be held with respect to the Settlement on February 10, 2017, at 9:00 A.M. before the Honorable Christine M. Arguello in the United States District Court for the District of Colorado, Alfred A. Arraj United States Courthouse, 901 19th Street, Courtroom A602, Denver, CO 80294.
The purpose of the hearing is to determine, among other things, whether the proposed Settlement of the securities class action claims asserted in this Action, pursuant to which ADES, on behalf of all Defendants, will cause to be deposited into a Settlement Fund the sum of three million, nine hundred-fifty thousand dollars ($3,950,000) in exchange for the dismissal of the Action with prejudice and a release of claims against the Defendants and other Released Parties, should be approved by the Court as fair, reasonable, adequate and in the best interests of the Class. If you purchased or otherwise acquired ADES common stock (ticker symbol: ADES) during the Class Period, you may be entitled to share in the distribution of the Settlement Fund if you submit a Proof of Claim Form no later than February 10, 2017 to the Claims Administrator, and if the information and documentation you provide in that Proof of Claim Form establishes that you are entitled to a recovery.
