CLARITY Act at the Brink: Senate Cloture Vote Could Make or Break U.S. Crypto Regulation

The CLARITY Act has cleared the House and Senate Banking Committee but remains stalled on the Senate floor ahead of its first major test. The House passed H.R. 3633 on July 17, 2025, by a 294–134 vote that included 78 Democrats. The Senate Banking Committee advanced the bill 15–9 in May 2026, yet no floor action occurred before the August recess. The next critical step is a procedural cloture vote scheduled for September 15, 2026, at 2:15 p.m. ET, which would determine whether debate can end and formal consideration begin.

Republicans hold 53 seats and will need at least seven Democratic or independent votes to reach the 60-vote threshold required for cloture. The White House has signaled strong support through crypto adviser Patrick Witt, treating September 15 as a key deadline, but ongoing disagreements over ethics provisions and other issues have sharply lowered the bill’s odds of becoming law in 2026. Negotiations remain unresolved, leaving the outcome uncertain despite the administration’s commitment to push the measure forward.

A successful cloture vote would mark progress by opening the door to amendments and a final Senate vote, though it would not guarantee passage. Failure to reach 60 votes would likely be viewed as a major setback for U.S. crypto market-structure legislation, potentially pressuring tokens most exposed to regulatory classification uncertainty and weighing on broader market sentiment.
