The complaint accuses the defendants of violations of the Securities Exchange Act of 1934 by virtue of the defendants’ failure to disclose during the Class Period that: Agile’s Twirla contraceptive patch had an efficacy rating that fell below peer group standards; over half of the patients in its “Secure” Phase 3 Study dropped out of the study early; and, the Twirla patch had a slim chance for U.S. Food and Drug Administration (“FDA”) approval.
According to the complaint, following a January 3, 2017 announcement that the Twirla patch’s efficacy measure failed to meet the industry standard for FDA approved contraceptives and that 51.4% of patients failed to continue the study to completion, the value of Agile shares declined significantly.
