In a significant move influenced by environmental groups, a U.S. appeals court temporarily blocked the approvals and permits necessary for Kinder Morgan to proceed with constructing its 32-mile Cumberland Project in Tennessee. The decision, made by the Cincinnati-based 6th U.S. Circuit Court of Appeals, pauses the development of the natural gas pipeline, which could transport approximately 245,000 dekatherms of natural gas per day to power Tennessee Valley Authority (TVA) facilities.

Environmental Groups Challenge Kinder Morgan’s Pipeline Project

Two prominent environmental organizations, Appalachian Voices and Sierra Club, requested the stay, arguing that the pipeline could cause significant environmental harm. The pipeline project, managed by Kinder Morgan's subsidiary, Tennessee Gas Pipeline, has drawn scrutiny for its potential impact on local ecosystems and water quality.

Court Decision on Tennessee Gas Pipeline

In a 2-1 ruling, the appeals court placed a temporary hold on the Tennessee Department of Environment and Conservation’s water quality certification and the permit issued by the U.S. Army Corps of Engineers. The court emphasized the need for time to fully evaluate the environmental concerns raised by the organizations before allowing the project to continue. Further arguments are scheduled for December, with the court expected to examine the case in more detail.

Kinder Morgan's Response to the Pipeline Halt

A Kinder Morgan spokesperson expressed the company's disagreement with the court's decision but noted that they would continue to review the ruling and assess their legal options moving forward. As of yet, neither Appalachian Voices nor Sierra Club have issued public statements regarding the court’s decision.
