About the Lawsuit
Embraer and certain of its executives are charged with failing to disclose material information during the Class Period, violating federal securities laws.
The alleged false statements include, but are not limited to, that Embraer had paid bribes to officials in the Dominican Republic to secure contracts for the sale of aircraft, a scheme that Embraer’s President and Chief Executive Officer was aware of.
On July 29, 2016, Embraer revealed that negotiations with the U.S. Department of Justice and Securities and Exchange Commission for the settlement of the allegations of non-compliance with the U.S. Foreign Corrupt Practices Act had progressed to the point that the company was recognizing a $200 million loss contingency.
