Three Tennessee plaintiffs, two of whom were minors at the time the images were created, have filed a federal lawsuit in San Jose, California against Elon Musk's artificial intelligence company xAI. The suit alleges that xAI deliberately engineered its Grok image generator to allow users to produce sexually explicit content using real photographs of unsuspecting individuals, including children.
The plaintiffs are seeking class-action status on behalf of all Americans who were "reasonably identifiable" in AI-generated sexualized images or videos created from their actual photos. They are pursuing unspecified damages, legal fees, and a court injunction to force xAI to stop the alleged practices. xAI has not publicly responded to the allegations.
The case centers on claims that xAI failed to implement adequate safeguards against the generation of child sexual abuse material (CSAM) through its platform. According to the plaintiffs, real images such as school photos and family pictures were digitally manipulated into explicit content and subsequently distributed across online platforms, causing severe emotional harm and constituting a public nuisance.
Attorney Annika Martin of Lieff Cabraser Heimann & Bernstein, representing the plaintiffs, stated that Grok was purposefully built to generate sexually explicit content for financial gain, with no consideration for the children and adults who would suffer the consequences.
Following public backlash over Grok's misuse earlier this year, xAI announced in January that it had restricted users from editing images of real individuals in revealing clothing and blocked such content generation in jurisdictions where it is prohibited by law. Critics argue these steps were insufficient and implemented too late.
The lawsuit arrives amid growing global scrutiny of AI platforms, with governments and regulators worldwide launching investigations and enforcing stricter content safety requirements to combat illegal and harmful AI-generated material.
